Wellbeing Log - Professional Student Wellbeing Management

1. Acceptance of Terms

By accessing or using Wellbeing Log, you agree to comply with and be bound by these Terms of Use. If you are using the App on behalf of an educational institution, organization, or employer, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

Wellbeing Log is a mobile application designed for educational institutions to:

• Track student wellbeing and attendance
• Manage room head counts (wellbeing room, diverse learners room, lunch room)
• Record student entry and exit times
• Generate statistics and reports
• Synchronize data across multiple devices using CloudKit

3. Eligibility

3.1 Age Requirements

The App is intended for use by educational professionals (teachers, counselors, administrators) who are at least 18 years of age or the age of majority in their jurisdiction. The App is not designed for direct use by students or children under 13 years of age.

3.2 Account Requirements

To use CloudKit synchronization features, you must have:

• A valid Apple ID
• An iCloud account (free tier is sufficient)
• A compatible iOS device (iOS 15.0 or later)

4. Trial Period and Purchases

4.1 Free Trial

Wellbeing Log offers a 30-day free trial period:

• The trial provides full access to all premium features
• No credit card or payment information is required to start the trial
• The trial begins when you first launch the App
• After the trial period expires, you must purchase the premium version to continue using all features

4.2 Premium Purchase

After the trial period, you may purchase the premium version:

• Premium is available as a one-time in-app purchase ($9.99 USD)
• Purchase is processed through Apple's App Store
• Payment is subject to Apple's payment terms and conditions
• Premium provides lifetime access to all features
• No recurring subscriptions or fees

4.3 Refunds

Refund requests must be submitted through Apple's standard refund process. We do not process refunds directly. Apple's refund policy applies to all purchases.

5. Acceptable Use

5.1 Permitted Use

You may use Wellbeing Log for:

• Legitimate educational purposes
• Tracking student wellbeing and attendance in educational settings
• Generating reports for educational institutions
• Data management for student services

5.2 Prohibited Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe on the rights of others
• Attempt to reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App to collect data without proper authorization or consent
• Share your account credentials with unauthorized users

6. Educational Institution Responsibilities

Educational institutions using Wellbeing Log must:

• Privacy Compliance: Comply with applicable privacy laws (FERPA, COPPA, GDPR, etc.)
• Consent: Obtain necessary parental/guardian consent for student data collection where required
• Security: Implement appropriate security measures for devices accessing student data
• Policies: Follow your institution's data protection and privacy policies
• Training: Ensure staff using the App are properly trained on data protection
• Retention: Establish and follow appropriate data retention and deletion policies
• Notification: Inform students and parents about data collection practices as required by law

7. Data and Privacy

7.1 Your Data

You retain ownership of all data you enter into Wellbeing Log. We do not claim ownership of your data.

7.2 Data Storage

Your data is stored:

• Locally on your device
• In Apple's CloudKit infrastructure (if sync is enabled)
• Subject to Apple's Privacy Policy for CloudKit data

7.3 Privacy Policy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect information. Please review the Privacy Policy carefully.

8. Intellectual Property

8.1 Our Rights

Wellbeing Log, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws. All rights are reserved.

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to:

• Download and install the App on compatible iOS devices
• Use the App for its intended educational purposes
• Access and use the App during the trial period or after purchasing premium

8.3 Restrictions

This license does not permit you to:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Remove or alter copyright notices
• Use the App for commercial purposes beyond educational use

9. Disclaimers

9.1 "As Is" Service

Wellbeing Log is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

9.2 Data Accuracy

While we strive for accuracy, we do not guarantee that:

• All data will be error-free
• The App will meet all your requirements
• CloudKit synchronization will always be instantaneous
• The App will be available at all times

9.3 Third-Party Services

The App relies on Apple services (CloudKit, App Store, iCloud). We are not responsible for:

• Apple service outages or interruptions
• Changes to Apple's services or policies
• Issues with Apple ID or iCloud accounts

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, or business opportunities
• Service interruptions or failures
• Errors or omissions in the App
• Any damages arising from your use or inability to use the App

In no event shall our total liability exceed the amount you paid for the premium version of the App, or $9.99 USD, whichever is greater.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Your collection or use of student data
• Any third-party claims related to your use of the App

12. Termination

12.1 By You

You may stop using the App at any time by:

• Deleting the App from your device
• Disabling CloudKit sync in iCloud settings
• Clearing all data from the App

12.2 By Us

We reserve the right to suspend or terminate your access to the App if you:

• Violate these Terms of Use
• Engage in fraudulent or illegal activity
• Misuse the App or its features

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Including a notice in the App if changes are significant

Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developer operates, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App should be resolved through:

16. Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of Wellbeing Log and supersede all prior agreements and understandings.
